Touchwood provides protection to its clients through a variety of legal safeguards including:
- Touchwood Forestry Agreement - The legally binding Touchwood Forestry Agreement provided to clients specifically addresses all relevant matters relating to the product, including but not limited to plantation establishment, management of the trees as well as the harvest thereof. The Agreement is entered into between the parties to ensure that the obligations and rights of all parties are known and agreed to from the onset.
Land Lease – A land lease is provided by Touchwood if requested to the client in respect to the plot of land upon which their trees are grown for the duration of the Touchwood Forestry Agreement. - Transfer Rights – Clients have the right to transfer ownership of their Touchwood Forestry Agreement to another party at any stage of the Agreement term provided that the client completes the necessary legal transfer documents provided by Touchwood.
The basic features of Touchwood’s Forestry and Lease Agreement are as follows:
- The client will own the trees outright. To this end, the Company will signpost each of the client’s Tree’s with a unique identification number which shall ensure that the client’s trees are readily identifiable.
- The Forestry Agreement gives clients considerable scope and power, especially with regard to the harvesting of their trees. Indeed, upon the client’s trees being harvested, the client can opt to have the Company sell the harvested trees on their behalf or have the harvested trees available for them at the plantation site for them to take delivery of.
- The Forestry Agreement gives clients a number of other rights and benefits, including the right to appoint a beneficiary in respect to the client’s harvest provided that the client completes and submits the necessary forms.
